12 Month Salon Membership Agreement
1. Membership
By signing this Application Form I agree to comply with the Terms and Conditions as set or amended by Lovely Skin and Beauty at its discretion. I may use my benefits if my member benefits are paid.
2. Duration
When you join as a salon member you agree to remain a member and pay for a minimum fixed 12-month commitment period from todays date, until the same day of the month, 12 months later. eg. If applying for membership on the 5/8/2022, the end date of the commitment period will be the 5/8/2023. However, your membership will continue unless specified as per our terms of termination. The Commitment Period is subject to extension if placed on a suspension period. Termination of membership may only be after the end of the Commitment period with 30 days’ written notice as set out below.
3. Membership Fees
Payments are charged on a 28-day cycle which continues automatically after the Commitment Period end date at the applicable membership fee rate on that date. Lovely Skin and Beauty will set and review fees and reserves the right to change the level of fees but guarantees that the level of your Membership fees will not increase during your Commitment Period. We will give 30 days’ written notice of membership fee changes.
4. Default and Late Payment
4.1) You are responsible for funds being available on your card for processing each 28th Day. We will contact you if payment fails and we will attempt to charge up to three times to recover the failed payment. A fee of $30 and/or a $10 failure letter fee will apply each time the payment fails 2 or more times over the course of your membership. Members must provide updates regarding new credit card details to enable processing of membership subscriptions for each 28-day cycle.
4.2) Outstanding fees which are not paid within 30 days of the due billing cycle will mean the full remainder of the Commitment Period will be billed to you and will be due for immediate full payment. E.G If 10 months remains in your commitment period the outstanding cycle plus the 10 months remaining will be due for immediate payment.
4.3) Unpaid and overdue membership fees will be referred to a debt collection agency and will be subject to a surcharge of $60 to cover the collection costs incurred. This surcharge plus legal fees incurred in the collection of the overdue Membership fees will be your legal responsibility and will be legally recoverable from you.
4.4) A $30 fee applies for transfer of memberships to another person.
4.5) Lovely Skin and Beauty takes no responsibility of finding a suitable candidate to transfer a membership to and reserves the right to deny the transfer if the applicant is deemed unsuitable.
5. Active Referral Scheme
5.1) The salon operates a Member Referral Scheme whereby you may receive a benefit to give to a friend to introduce potential new members to the Salon. We reserve the right to impose that referral gifts can be supplied once only per friend as an introductory gift to try our salon services strictly with a view to joining as a salon member.
5.2) The gift is not exchangeable for other services, nor redeemable for cash or products. The offer is not a just a gift to give away.
6. Suspension of Membership due to Illness or Injury
If you are unable to utilise your Membership due to illness or injury, you may suspend your Membership for one continuous period of at least 1 month and a maximum of 3 months. To suspend your Membership 30 days written notice must be given to Lovely Skin and Beauty and we shall have the right to request a Doctor's certificate to confirm your illness or injury. Suspension during the Commitment Period does extend the length of the Commitment Period by the length of the period of suspension. Notice to terminate Membership cannot run concurrently with a suspension period.
7. Termination of Membership
You may terminate this agreement in the following circumstances:
7.1) End of Commitment Period: ONLY at the end of the 12-month Commitment Period, you may terminate your Membership by giving at least 30 days written notice which shall expire either on the Commitment Period end date or at the end of the immediately following billing cycle. Cancelling credit card instructions for the payment of fees is not sufficient and does not legally constitute service of written notice.
7.2) Medical: You may terminate this agreement with 30 days written notice if you are unable to use the Salon due to serious illness or injury likely to preclude you from treatments for a period of at least 6 billing cycles. We reserve the right to require evidence of your illness or injury -e.g., Doctor's certificate before we accept notice of termination.
7.3) Relocation: if you move outside of a 30km radius of the location of the Salon within the Commitment Period and it is impractical to attend the Salon. You may terminate this agreement by giving at least 30 days written notice which shall expire at the end of the immediately following billing cycle. Proof of new address such as utility or council rates bill in your name must be provided with the written notice.
7.4) Redundancy: In the event of redundancy from your main employment you may cancel your Membership by providing a formal redundancy letter with at least 30 days written notice to the Salon Manager who will evaluate your cancellation request. The membership will terminate at the end of the following billing cycle following our acceptance of your notice for request of cancellation.
8. Safety Notices
Abusive or violent behaviour, abuse of facilities, alcohol or illegal substances use, or smoking at the Salon may result in suspension or termination of Membership with the full membership fee for the remainder of the Commitment Period declared due and payable.
9. Sale of Salon and your Membership
If the Salon is sold, membership will continue under the new owner. You will continue as a member and continue to pay your membership fees with no changes to these terms or the Salon rules having a material adverse effect on your use of the Salon. A sale of the Salon will not affect your contractual or statutory rights.
10. Written Notices
Notices from you must be in writing and addressed to the Salon
Manager. Lovely Skin and Beauty reserves the right to require evidence of posting or delivery where it has no record of receipt, or the date of any notice appears inconsistent with the date of receipt. The notice will be deemed not given unless such evidence is provided. Notices handed to salon personnel must be receipted.
11. Booking Member Appointments
11.1) We assist members with booking their appointments when in salon from visit to visit however, Members are responsible for availing themselves of their eligible member benefits and appointments including free services, discounted services, and discounted products.
11.2) Missed appointments or reschedules under 24hrs notice will be considered member benefits used for that particular month.
If less than 24 hours’ notice of rescheduling or failure to attend any appointment even if a deposit has been paid, the appointment is considered used in respect that the salon specifically reserved the appointment time and rostered a therapist for your service.
